Thank you for visiting the website of Henchman Unit Trust US EIN 862-64-0090 trading as Henchman Products ("Henchman", "Henchman's", "we" and "our").  By using or accessing our website, you agree to the following terms and conditions ("Terms of Use") and to our Privacy Policy.

1. Use of Website

You agree that the use of all information or data of any kind contained on this website, including but not limited to text, software, code, music or sound, photographs, graphics, video or other materials ("content") is at your sole risk.  Henchman is not liable to you (Buyer) or anyone else for any loss suffered in connection with the use of this website, any of its content including external links or for any loss incurred as a result of damage to your computer systems or the transmission of any computer viruses.

2. Acceptance

All goods sold as listed on any invoice shall be deemed to have been received in good order and condition without shortage unless notified to the contrary within seven (7) days of delivery.  If the Buyer fails to notify Henchman in writing of its rejection and the reason therefore within such time period, the Buyer will be deemed to have accepted such consignment.

3. Refund & Exchange policy

Goods returned for credit, and orders cancelled will only be accepted subject to Henchman's prior agreement with all freight charges prepaid by the Buyer. Returned goods (if accepted) are subject to a re-stocking fee of ten percent (10%) of the invoice price. Returns will only be accepted (if accepted) within 14 days from date of invoice. Exchange of goods may be accepted if item is in the original packaging and not marked and still in a saleable condition. All refunds or exchanges will be entirely at Henchman's discretion. Order cancellation (if accepted) may be special order items and therefore non-cancellable), order cancellations may incur additional re-stocking fees depending if the item needs to be returned to the supplier.

4. Pricing - Australia

All published prices by default are in Australian Dollar (AUD) and are subject to alteration without notice.  All prices quoted and displayed are exclusive of GST and ex store point of consignment.

5. Pricing - International

All published prices by default are in Australian Dollar (AUD) and are subject to alteration without notice. Other currencies can be selected for shopping though the final payment will be processed in AUD. All prices quoted and displayed are exclusive of GST and ex store point of consignment. Legitimate export orders will not have GST billed.

6. Transport - Australia

Freight charges apply to all orders with the exception of back-ordered items.  Freight cost and risk of loss in transit is the responsibility of the Buyer.  A standard freight charge of $15 AUD will be added to invoice for all local purchases except in the case of dangerous goods where freight will incur additional cost, each charge is to be worked out accordingly based on the request at the time. 

Same Day Dispatch is available on in-stock items ordered before 3pm AEST/AEDT (Sydney).

7. Transport - International

Freight cost and risk of loss in transit is the responsibility of the Buyer.  Freight will be made using the Buyers freight account where specified, otherwise quoted per order by Henchman.

8. Title & Risk

Title to and property in the goods shall only pass to Buyer following Henchman's receipt of all monies payable by Buyer hereunder.  Risk of loss in transit where goods are despatched using the buyers freight agent is the responsibility of Buyer. 

9. Delivery Time

All quoted delivery or consignment dates are estimates only, given without engagement.  Delay in consignment of any part of an order shall not relieve Buyer of its obligation to accept and pay for the remainder of the order.  Goods offered ex-stock by Henchman are subject to prior sale.  In the event of any happening beyond Henchman's reasonable control in consequence of which Henchman cannot effect consignment by the time or times quoted or specified, Henchman shall be entitled to consign part only of an order, suspend consignment or extend the time for consignment, for the period during which such cause of delay operates, or may cancel the order, and in the event of such suspension, extension or cancellation, Henchman shall not be liable for damages. 

10. Product Warranties

All warranties conditions and representations whether express or implied other than any express warranty stated by the Henchman in writing are hereby expressly negative and excluded except in circumstances where the Henchman is by law unable to exclude or limit its liability.  Henchman warrants that the goods sold be free from defects solely due to faulty workmanship and materials during a period of 12 months from consignment (in certain cases limited lifetime warranty).  Goods altered, repaired or subjected to any technical attention by any person other than Henchman's authorised representatives without Henchman's consent will not be covered by warranty.  Damage due to normal wear and tear, improper installation, misuse or neglect or where goods have been subjected to operating or environmental conditions in excess of maximum values in the applicable specification are not subject to warranty.

Henchman shall not be liable for any consequential damage/s including loss of profits resulting from the use of goods sold found to be defective, where warranty shall be limited to either:

a.   the replacement of the faulty goods or the supply of equivalent goods only;

b.   the payment of the costs of replacing the goods or of acquiring equivalent products.

No claim of any nature whatsoever (other than warranty) will be recognized unless made within ten (10) days of delivery. All freight costs involved in returning goods are to be borne by the Buyer. A copy of the invoice evidencing such sale is to be included with the goods.

11. Limitation of Liability

You agree that the use of this website and of any services or content contained on this website is at your own risk. Henchman will, in no circumstances, be liable for any incidental, indirect or consequential damages, including damages for loss of opportunity, loss of business or loss of profits arising from the use of this website. You agree to indemnity and keep Henchman and its representatives, officers, directors, employees, agents and contractors indemnified from any claims or demands (including legal fees on an indemnity basis) which have arisen as a result of your use of this website.

Henchman makes no warranties, either express or implied, that any part of this website or its services will be uninterrupted, error-free, timely, secure, accurate or reliable. Henchman expressly disclaims all conditions and warranties of any kind relating to the content of this website, either express or implied, to the maximum extent permitted by law.

12. Anti-Spam notice

The publication of any email addresses on our website is for the purpose of professional communication only and must not be used to infer consent to the receipt of unsolicited commercial email messages.

13. Accuracy of Information

Henchman shall make all reasonable endeavours to ensure the accuracy and currency of the information on this website, however Henchman advises that the information may contained errors or omissions and is subject to change.  Henchman makes no warranties or representations regarding the quality, accuracy, completeness, fitness for purpose of any content contained on this website

Unless otherwise stated, Henchman owns the intellectual property including all copyright in all content on this website. Henchman reserves its rights, including but not limited to any and all copyright, trademarks, patents, trade secrets and any other proprietary rights that Henchman has with respect to this website, its content and its services.

15. Privacy Policy

At all times, Henchman shall comply with its Privacy Policy and the Privacy Act 1988 (Cth) as applicable.

16. Links to other websites or service providers

Henchman may display links of external service providers for your convenience only. Unless otherwise stated, any links to external websites should in no way be construed as an endorsement or an affiliation with the services provided by the external website.  Any representations made by such external third parties with respect to their goods and services are the sole responsibility of the third party.  Henchman is not in any way liable for any dealings between the user and the third party.

Henchman does not make any warranties or representations that content on linked websites does not infringe intellectual property rights of any person anywhere in the world. Henchman does not authorise any infringement of any intellectual property rights contained in material on other site by providing a link to a third-party site.

17. Internet security

Henchman endeavours to protect personal and sensitive information however Henchman is not liable for any breach of security that may or may not occur as a result of using or accessing this website.  For web orders where cards details are disclosed to Henchman - the details will be kept secure and will not be retained on our system for security purposes
